- You will not inject viruses, Trojan horses, worms, time bombs, cancelbots, or malicious scripts engineered to compromise, disrupt, or crash the structural integrity of the Platform.
- You will not attempt to gain unauthorized entry to administrative servers, cloud databases, or customer accounts.
- You grant Storm Pros an irrevocable, perpetual, non-exclusive, fully-paid, worldwide, sublicensable license to use, reproduce, modify, and distribute any structural images, damage media, or property data you upload to the Platform for marketing and estimating purposes.

4. Mandatory Florida Construction Disclosures (Fla. Stat. 489.147)

Storm Pros Roofing and Impact LLC operates as a licensed roofing and construction contractor in the State of Florida. We strictly enforce compliance with all anti-fraud regulations under Florida law.

No Deductible Waivers or Rebates: Pursuant to Fla. Stat. 489.147(2)(b), a contractor may not directly or indirectly offer a residential property owner a rebate, gift, gift card, cash, coupon, waiver of any insurance deductible, or any other thing of value in exchange for allowing the contractor to conduct an inspection of the roof or making an insurance claim for damage. It is insurance fraud punishable as a third-degree felony for a contractor to pay, waive, or rebate all or part of an insurance deductible. The property owner is entirely responsible for the payment of any applicable insurance deductible.

No Prohibited Referrals: We do not offer, deliver, receive, or accept compensation, inducements, or rewards for the referral of any services for which property insurance proceeds are payable.

Public Adjusting Prohibition: Storm Pros is a licensed roofing contractor, not a public adjuster. We do not interpret insurance policy provisions, advise insureds regarding coverages or legal duties under property insurance policies, or adjust property insurance claims on behalf of the insured unless explicitly licensed to do so.

If the proposed work is related to an insurance claim, you, the residential property owner, should contact your insurance company to verify coverage for the proposed roofing work, including any claims, deductibles, and policy terms, before signing a final contract. By submitting your project through this platform, you acknowledge that you have been advised to contact your insurance provider regarding coverage and reimbursement of the proposed work.

5. Liquidated Damages Framework

Because calculating the exact economic damages resulting from platform abuse, cyber-scraping, and fraudulent submissions is mathematically complex, you agree that if you violate the provisions of this Agreement, you shall be liable to pay Storm Pros Roofing and Impact LLC the following fixed amounts as pre-determined liquidated damages, which you acknowledge represent a reasonable and fair estimation of harm:

- 1000 dollars per instance for any false, misleading, or fraudulent contact information or property details submitted to our database.
- 1000 dollars per item of content copied, displayed, reproduced, or exploited from our website for unauthorized commercial use.
- 100 dollars per database record or individual consumer profile extracted, aggregated, scraped, or compiled using artificial computer software or automated scripts.

6. Complete Disclaimers and Absolute Liability Caps

As-Is Provision: The platform, its digital tools, pricing estimators, and content are provided entirely on an AS IS and AS AVAILABLE baseline without warranties of any kind, either express or implied. We do not warrant that website functionality will be uninterrupted, error-free, secure, or free from server latencies.

Liability Exclusion: To the maximum extent permitted under applicable Florida law, Storm Pros Roofing and Impact LLC, its managers, officers, members, employees, and legal representatives shall never be held liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages (including lost profits, loss of data, property damage, or business interruption) arising out of or in any way linked to your use of this platform, whether rooted in contract, tort, strict liability, or statutory claims.

Venue: The arbitration proceedings shall take place in the county where our corporate headquarters resides or where your real property is physically located, governed by the Federal Arbitration Act (FAA). The arbitrator, and not any federal, state, or local court, shall possess exclusive jurisdiction to determine arbitrability, applicability, and contract formation.

Absolute Class Action Waiver:You and Storm Pros Roofing and Impact LLC explicitly agree that each party may bring claims against the other only in an individual capacity, and not as a plaintiff, representative, or class member in any purported class, collective, or representative proceeding. The arbitrator is completely unauthorized to consolidate more than one individual's claims or preside over any form of class arbitration.
